The China Maritime Safety Administration (CMSA) has issued important guidelines regarding the entry of foreign-flagged ships into Chinese internal waters in emergency situations. This advisory, effective from March 1, 2025, aims to ensure compliance with reporting requirements for incidents such as mechanical failure, distress, adverse weather conditions, and medical emergencies.
Why Foreign-Flagged Vessels Must Comply
Starting March 2025, foreign vessels entering Chinese internal waters due to emergency situations, such as urgent illness or mechanical breakdown, must report their entry to the CMSA. The guidelines are particularly relevant for vessel seeking entry without prior port clearance. These new regulations are part of China’s efforts to enhance maritime safety and streamline communication between foreign vessels and local authorities.
Key Reporting Requirements for Foreign Vessels
1. Reporting Channels for Emergency Situations
When a foreign-flagged vessel enters Chinese waters in an emergency, shipowners and operators must use one of the following reporting channels:
- Marine radiotelephony (DSC on VHF/MF/HF)
- Marine satellite telephone, wired telephone, or fax
- Maritime Search and Rescue national hotline “12395”
- Other effective means of communication
2. Emergency Report Form Submission
Once the vessel enters Chinese internal waters, the shipowner must submit the Emergency Report Form as soon as possible. This ensures that the vessel’s emergency status is officially recognized by the CMSA.
3. AIS Reporting Protocol
If the vessel’s AIS (Automatic Identification System) is non-operational after entering Chinese waters, it is required to provide hourly updates until departure or until port entry permission is granted. These updates must include:
- Ship name, call sign, and IMO number
- Current position, intended course, and speed
